MODULE I
INTRODUCTORY SESSIONS: IMPORTANCE OF TRADE IN SERVICES

These sessions will cover the broad context to be taken into account by officials responsible of the administration of agreements in the area of services and seek to highlight the importance of an efficient management of these agreements given the implications of services and trade in services for the economy of a country.

    This session will provide an introduction to the peculiarities of trade in services that distinguish it from trade in goods and that explains the different architectures used by the WTO and the free trade agreements as a framework for trade in services. It will also examine the importance of services in the Mexican economy and the reasons why Mexico has included this sector in all of its trade agreements.

    This session will examine: the differences in the architecture of multilateral services agreements and regional agreements under a negative list approach; the structure of regional trade agreements; the manner in which services are treated in different chapters of the agreements and the way it all fits together. Using concrete examples, the GATS Lists of Specific Commitments will be compared to the Non-Conforming Measures Annexes of regional trade agreements.

ADMINISTRATION: DIFFERENT INSTITUTIONAL ARRANGEMENTS

This series of sessions will explore the different institutional arrangements that countries have implemented for the administration of their agreements in the area of services including, among other issues: who is responsible for the administration of the agreement; the mechanisms for inter-institutional coordination among government entities, regulators and other actors such as the private sector; and, the relationship with the services export sector.

    Esta sesión examinará los cambios legales (marco jurídico) e institucionales que han sido necesarios para implementar y administrar los acuerdos referidos a los servicios de autotransporte en el contexto de los tratados de libre comercio suscritos por México incluyendo, entre otros temas: quién es el ente responsable de la administración de los acuerdos; cómo se maneja la coordinación interinstitucional entre entidades gubernamentales y otros interesados ; cómo se compatibiliza el cumplimiento de diferentes niveles de disciplinas asumidos en los acuerdos regionales y a nivel multilateral; cómo se enfrentan los retos de contar con los expertos requeridos para el manejo de temas de alta complejidad; qué tipo de apoyo se da a los exportadores de servicios de autotransporte cuando enfrentan dificultades en los mercados externos; cómo ha sido el proceso de la  Disputa sobre Transporte de Carga bajo el TLCAN.

    The use of dispute settlement mechanisms under the FTAs and the WTO is a very important aspect of the administration of these agreements. This session will examine the three dispute settlement cases in the WTO related to trade in services: Measures Affecting Telecommunications Services; Regime for the Importation, Sale and Distribution of Bananas; Measures Affecting the Cross-Border Supply of Gambling and Betting Services.
